No Christmas Presents For Convicted Drugs Trafficker

 

At a Confiscation hearing on the 21st December 2005 at Birmingham Crown Court, before HHJ Ross,  Jason Scott MILLER, 34, of Coventry, Warwickshire was assessed to have benefitted by £41,374.40, with an available amount of £11,865.52. He must pay by 01/03/2006, or serve a sentence of 12 months in default.

 

On Friday 23rd July 2004 Jason Scott MILLER, 34, of Coventry, Warwickshire, was seen to sell Controlled Drugs in Dartmouth Road, Coventry. He was approached by Police Officers and subsequently arrested. At the time of arrest the defendant had on his person £935 in cash and in his own motor vehicle a Ford Focus, vehicle registration mark T582WMW, 27.9 grammes of Crack Cocaine were seized. Following his detention, MILLER’s home address was searched.

Items of interest seized from this property included;

In a kitchen drawer, 20.9 grammes of Heroin, a small amount of Crack Cocaine and two sets of Electronic/Digital Scales.

Secreted in the kitchen ceiling rafters, a wallet containing, £580 Cash and personal cards relating to MILLER. A Crossbow, two CS spray Cannisters and Body Armour.

On the 24th July 2004, Jason Scott MILLER was charged with both ‘Possession of Class A Drugs [Heroin and Crack Cocaine] With Intent to Supply’, ‘Possession of an offensive weapon’ [A Locking Knife] and the possession of two CS spray Canisters.

On the 7th January 2005, MILLER appeared at Birmingham Magistrates Court where he subsequently pleaded Guilty to all Charges. Miller was sentenced to ten years imprisonment and faced a further investigation into his financial position.

Following the financial investigation, a Confiscation hearing took place on the 21st December 2005 at Birmingham Crown Court, before HHJ Ross. The Benefit Figure was assessed at £41, 374.40, with an available amount of £11,865.52. Miller was ordered to pay the available amount by the 1st March 2006 or he would face a sentence of 12 months in default of payment.

 

In all the following were seized from MILLER’s person or property;

 

£1,515 Cash seized, 22.46 grammes of Heroin, 40.49 grammes of Crack Cocaine and 0.68 grammes of Cannabis.

 

HHJ Ross ascertained that ‘ Miller had lived a Criminal Lifestyle living on the proceeds of his criminality’.
