Deception doesn’t pay

John Antonio FERNANDEZ from Rugby, Warwickshire is required to pay £14,000 within 9 months or face a further 12 months in prison.

In August 2005, John Antonio FERNANDEZ, 59,  from Rugby, Warwickshire was convicted at Warwick crown court in relation to making false claims in order to obtain via deception over £28,000 worth of Council Tax Benefits. He subsequently received a 27 month prison sentence for these offences. During the period of these illegitimate claims FERNANDEZ had been working as a self-employed builder and at one stage owned two houses that he later sold. Rugby Borough Council brought a prosecution against him and later referred the case to the Midlands RART to carry out a confiscation investigation.

The Confiscation hearing was held at Warwick Crown Court on 3rd April 2006. The court ruled that FERNANDEZ had to pay a Confiscation Order of £14,000 within 9 months or face another 12 months imprisonment.

The money will eventually be repaid to Rugby Borough Council as compensation.
